Eligibility for Veterans Disability Benefits
To qualify as disabled, a veteran would have to prove that they have a known injury or illness, whether physical or mental, and that they served on active duty, active duty for training, or inactive duty training. A veteran’s discharge status also affects their eligibility to receive disability benefits.
The first step in applying for disability benefits would need to be applying for a discharge upgrade if you were given:
- An other-than-honorable discharge
- A bad conduct discharge
- A dishonorable discharge
To qualify for disability benefits, a veteran would also have to prove that the condition was caused or aggravated by their military service:
- In-service disabilities – a disease or injury that started during service
- Pre-service disabilities – a prior disease or injury that worsened during service
- Post-service disabilities – a disease or injury that didn’t manifest until service ended
Furthermore, a chronic illness will be presumed to have been the result of service if it appears within a year of being discharged. A condition can also be assumed to be service-related if it was an illness caused by exposure to toxic chemicals or similar hazards, or if the illness was caused while being a prisoner of war.
